Following the election of the Bracks Labor Government in October 1999, an Energy and Resources portfolio was established with the appointment of a Minister for Energy and Resources. The portfolio comprised part of the former Agriculture and Resources portfolio (VRG 122), assuming responsibility for mineral resource development, mines, extractive industries, petroleum, pipelines, fisheries, the nuclear activities prohibition act, and renewable energy.

In June/July 2000, responsibility for energy transferred from Treasury (VRG 23). In June, 2000, as published in the government gazette, the function of energy policy was transferred from the Department of Treasury and Finance to the Department of Natural Resources and Environment, by declaration under the Public Sector Management and Employment Act 1998. This involved the transfer of the Energy Unit within the Commercial Policy and Projects Division of the Department of Treasury and Finance. Transfer of ministerial responsibility for Acts relating to the function doesn't appear to have been gazetted; nor does the transfer of responsibility for Acts between departments. The assumption of responsibility for the energy related Acts (for the market and regulatory functions under them) by the Department of Natural Resources and Environment is evidenced by Administrative Arrangements Order number 169 (concerned with appropriation of moneys), published in the government gazette on 8 March 2001. The order states that responsibility transferred on 1 July 2000. It is probably reasonable to assume that ministerial responsibility for the energy function transferred at this time also.

The Energy and Resources portfolio was abolished following the re-election of the Bracks Labor government in November 2002. For the most part ministerial responsibilities were split between a newly appointed Minister for Energy Industries (VRG 157) and a newly appointed Minister for Resources (VRG 158). Responsibility for fisheries transferred to the Minister for Agriculture (VRG 131). Responsibility for the Sustainable Energy Authority Victoria transferred to the Minister for Environment (VRG 147).
