  • How to use the Records
    To gain access to particular files in this series researchers will need to know the file or appeal number. An index to appeal files by municipality was created but has been retained by the Victorian Civil and Administrative Tribunal. See VPRS 8348 Card Index to Appeal Files (Planning).

    Note: Researchers should note that much of VPRS 4068 Town Planning Appeals Files and VPRS 3153 Town Planning Appeals Files have been destroyed in accordance with PROS 91/10 Records Disposal Schedule for Records of the Administrative Appeals Tribunal. In accordance with that disposal schedule all classes of records identified as temporary by the schedule were segregated and either marked for destruction or destroyed prior to the transfer of the permanent material into archival custody.

    PROS 91/10 identifies temporary Planning Division files as:

    - refused appeal files,
    - files relating to appeals heard where the Tribunal determines not to issue an order or declaration,
    - withdrawn applications,
    - files not otherwise classified.

    The schedule identifies permanent records of the Planning Division as being: all files documenting appeals and claims heard by the Planning Division in relation to:
    - drainage matters,
    - all granted or amended appeal files,
    - an annual random sample of 5 files per 1000 files identified as temporary.

  • Function / Content
    Constituted under the Town and Country Planning (Amendment) Act 1968, the Town and Country Planning Board had the responsibility of promoting and coordinating town and country planning within the State. Under Section 14 of the Act the Town Planning Appeals Tribunal was established to hear and determine all appeals against decisions of responsible authorities with respect to applications for permits. Appeals were to be in writing and stating the grounds of the appeal with the following sections setting out the procedures and processes to be followed by the Tribunal in hearing and determining appeals.

    The series in custody consists of a sample only of the files in VPRS 4068 Town Planning Appeals Files and VPRS 3153 Town Planning Appeals Files. The sample was retained according to the provisions of PROS 91/10 Records Disposal Schedule for Records of the Administrative Appeals Tribunal as described above.

    File titling was primarily by the municipality and then by details of the appeal. Inside the front cover of the file a pro forma was pasted giving a summary of the dates and file number, that the appeal satisfied statutory conditions and the dates and recipients of relevant correspondence. The file contents are the appeal as forwarded to the Tribunal with exhibits and / or submissions; report of the appeal hearing which may include transcripts of personal submissions and correspondence with the parties to the appeal.

    Prior to 1974 when an appeal was refused, a three page summary was fixed as the final papers on the file referring to Section 19 of the Act and Section 4 of the Regulations. This summary detailed all aspects of the course of the appeal including proceedings, notifications and advertisements with notes indicating the checking of the accuracy of details.

    From 1974 the summary records were attached to all files. The previously described summaries were now streamlined. The cover summary dealt with dates of correspondence, hearings, any advertisements and to whom the report of the appeal needed to be forwarded whilst the file face sheet gave details of the parties to the appeal and the municipality involved.

  • Recordkeeping System
    Until 1974, these files were part of VPRS 5397 General Correspondence Files, Multiple Number System of the Department of Local Government having been originally registered using the Departments multiple number system. They were subsequently top-numbered with a running number by the Tribunal. This number was known as the appeal number. The files were arranged in running number order.

    Files in the sample are similarly arranged in numerical order by appeal number.
