This series consists of files created by the Licences Reduction Board in relation to the process of hotel licence deprivation and surrender.
Background
The Liquor Licences Amendment Act 1906 (No.2068) made provision for the Board to systematically reduce the number of victualler's licences in Victoria with regard to the convenience of the public and the requirements of the locality. In particular, hotels which had incurred convictions under licensing regulations within the three years preceding the determination were considered for deprivation. However the Board could not reduce hotel licences in a district where the number of hotels was below the statutory number.
The licence deprivation process was directly linked to the compensation funds available for each year. The Board conducted surveys called "Maximums" throughout a district in order to establish the overall compensation requirements of the area, and having regard to the result, would select certain hotels for deprivation. (See VPRS 7722 Maximum Valuation Files.) The Board sat as a court to reach its decision and owners and licensees were summoned to show cause why their licence should not be deprived.
Contents
The files generally contain a Summons to Deprive of a Licence for owner and for licensee, a Notice of Deprival Sitting, and Particulars of Claim forms giving details of income, rent, profits and expenses for both owner and licensee. A certificate from the relevant Clerk of Courts proving no past infringements of licensing regulations or a convictions list was also included.
After these particulars were received the Board would reach a Deprivation Determination and issue the owner and the licensee with an official notice of licence deprivation. Notices advising the owner and licensee of Compensation Sittings to be held are often included in the file together with the relevant Maximum Compensation Claim forms and any correspondence resulting form the process of determination and compensation.
The Board also accepted licence surrenders from hotels which were initially listed as a possible target for deprivation in a district and whose owner's and licencees chose to terminate the licence under the provisions of the Act and thus receive some compensation. These files generally contain the original Victualler's Licence, returned to the Board as part of the surrender process.
System of Arrangement/Control
The series is arranged alphabetically by hotel name. Reference to the deliberations and decisions of the Board with regard to the deprivation and compensation process can be found in VPRS 7605/P1 & P2 - Minute Books of the Licences Reduction Board.
Subsequent licence and deprivation files were presumed not extant in 1989.
