Description of this Series
Description of this Series
How to use the Records
Entries in the index were arranged alphabetically by the surname of insolvent. Note the district in which the case was heard and the registration number of the case.
This volume is the only volume extant. The whereabouts of the index for the years 1876 to 1883 was not known (as at 2006).
Case files for the Melbourne Metropolitan Region for this period may be found in VPRS 759 Proceedings in Insolvent Estates for period 1842 to 1871 or VPRS 762 Deeds Under 1871 Insolvency Act for files created between 1871 and 1883.
Scan the Consignment Details for the relevant series and identify the unit containing the required case file.
For files for persons declared insolvent in country areas researchers should identify the relevant series listed for each court for example, Warrnambool courts. Insolvency Court Registers have survived in many instances where the case files have not.
Function / Content
In accordance with the provisions of section 21 of the Insolvency Statute 1871 (No.379) and the subsequent insolvency acts, the Chief Clerks of the Insolvency Districts in which the proceedings were prosecuted were required to send a copy of every order of sequestration or adjudication of sequestration to the Registrar-General. The orders were registered in VPRS 8748 Insolvency Register maintained by the Registrar-General.
VPRS 8747 Index to Insolvency Registers was created by the Office of the Registrar-General and the Office of Titles (VA 862) as part of a recordkeeping system which included Insolvency Registers created to register persons declared insolvent by various district courts.
Two separate registers were created, one for Geelong and country areas, see VPRS 8749; and another for the Melbourne and metropolitan region, see VPRS 8748.
The information recorded in the index includes:
- the name of the insolvent
- date of sequestration
- date of discharge certificates granted (entries made later)
- Insolvent District
- the case registration number allocated by the Melbourne or district court.
This series appears to have commenced in 1875 when the extant volume was compiled by a single compiler. The contents date range however, extends back to 1842. If similar indexes were created for the period 1876-1883, they were not extant at the time of transfer.
The series ended in 1883 when it was replaced by a Self Indexed Insolvency Register for the whole of Victoria, see VPRS 8750.
Related Court Records
Even though it was not created as part of the recordkeeping systems for insolvency court records, this series can be used to access files relating to insolvents created by the Court of Insolvency at Melbourne (VPRS 759 Proceedings in Insolvent Estates; VPRS 762 Deeds Under 1871 Insolvency Statute and for Geelong insolvencies, VPRS 815 Court of Insolvency Records, Geelong Courts.
Recordkeeping System
Entries were made in alphabetical order by surname of the insolvent for a consolidated period of time covered by each volume. The contents of the extant volume, compiled in 1875, relate to the period 1842-75.
Other indexes may have been created for various period of time.
