- How to use the Records
Researchers may use this series to obtain file (or case) registration numbers to access the files created for persons declared insolvent in Victoria during the period 1883 to 1928. However, the extant volumes only covers the period 1883-1898.
The insolvency register consists of two volumes within which insolvents were registered in alphabetical order by surname. Entries were made under the purst two letters of the surname. There were tabs on the edges of the volumes dividing the volume into section for surnames that commenced with Ba, Be, Br, Ca, and so on. Some of the tabs (which were attached to the edges of the pages) have broken off unit 3 of the P1 consignment.
The series in Public Record Office Victoria custody appears to be incomplete as there are no entries for names that commenced with A, E, F, I, N, O, Q, U, V, S, Y or Z let alone further two-letter combinations for the other letters of the alphabet.
The files may be located in different series created by various Insolvency Courts.
The Melbourne and Metropolitan Region: - VPRS 762 Deeds Under 1871 Insolvency Act - VPRS 765 Schedules Under the 1890 Insolvency Act.
Geelong and Country Areas: - VPRS 815 Insolvency Court Records.
The insolvency files created by other local Insolvency District Courts are listed in inventory of series for each individual court, for example, see VA 917 for Stawell Courts. Once the series is identified, scan the Consignment Details for that series to identify the number of the unit/box containing the required file.
- Function / Content
In accordance with the provisions of section 21 of the Insolvency Act 1871 and the subsequent insolvency acts, the Chief Clerks of Insolvency District Courts were required to send a copy of every order of sequestration or adjudication of sequestration to the Registrar-General.
The Office of the Registrar-General was responsible for the registration of persons declared insolvent by the Courts of Insolvency. Cases of insolvency were adjudicated upon locally. However, notices of all insolvencies in Victoria were sent to the Chief Clerk, Melbourne and the Registrar-General's Office and were also published in the Government Gazette.
The information recorded in the Register includes: - number of the schedule/case file registration number - name and occupation of the insolvent - name of the court (Melbourne, Benalla, Geelong, etc.).
The register appears to have been commenced in 1883 and ended in 1928 with the transfer of responsibility for the insolvency function to the Commonwealth Government. The contents date range extends back to 1882.
- Recordkeeping System
This register was self-indexed, that is each volume was divided into alphabetical sections by the initial letter and second letter of the surname, for example, into Ba, Be, Br, Ca, and so on. As mentioned above, it is doubtful that the records in custody would have constituted the series in its entirety.
Units 3 and 4 cover surnames that commence with certain letters of the alphabet, i.e., Ba-We (1883-1898).
Units 1 and 2 are not available for public inspection because of their fragile condition.
