- How to use the Records
For the Register of Grants for Special Purposes, consult the Consignment Details for the volume containing the date range for which information is required. Where indexes are available, the numbers of entries of grants in specific parishes may be found by reference to that index.
For the Register of Pre-Emptive Right Descriptions, consult Unit 2 and then one of the three available indexes: Parishes for examples in specific localities; Grantees Names for land acquired by specific individuals or Homesteads or Runs for information regarding specific properties.
- Function / Content
The Register of Grants for Special Purposes, also known as Grants Without Purchase, lists land granted for a wide variety of public purposes including recreation reserves, health facilities, municipal buildings and facilities and such things as libraries and Mechanics Institutes. Also listed are long-term leases of land granted to large companies for industrial sites. For each one a number is allocated, the date of the grant and the Government Gazette reference, the locality, the area of the land granted and the purpose and the dates when the grant was passed for signature and when it was sent to the Office of Titles. In the Remarks column may be found further details of the process and any special conditions imposed on the grantees. Other detail may be such things as the names of the original trustees for the land. References may be given for the copy of the Deed of Grant to be found in the Special Deeds Books (VPRS 14148). These are given as the volume of these books and may be entered in the Register in red ink.
Under the principle of pre-emptive right, licensees of runs were permitted to purchase a portion of their runs to provide some security of tenure at the minimum upset price of 1 pound per acre. In this way a homestead or land upon which improvements had been made could be secured. The actual criteria applied in deciding whether purchase could be made was the presence of improvements on the desired acreage. Pre-emptive rights were established under the 1847 Order-in-Council and were taken advantage of by squatters who had already settled upon large tracts of the land of the Port Phillip District.
The Register of Pre-Emptive Rights lists the number of the descriptions of pre-emptive rights (see VPRS 14147). Also given are the name of the purchaser or grantee, the Homestead or Run, the location and area of the land (county, parish or town, allotment and section), the dates of deed and when the deed was sent to the Treasury and other remarks. Descriptions are available in VPRS 14147 Pre-Emptive Right Descriptions.
The series date range is given as the date range of the contents. It is believed that this Register and the volumes containing the descriptions were created at an unknown time later than the dates of the records contained probably by the Deeds Branch of the Department of Crown Lands and Survey (VA 538)
Further details regarding land acquired under pre-emptive right may be found in VPRS 13016 Applications Register for the Purchase of Land Under Pre-Emptive Right and VPRS 122 Outwards Letter Books.
- Recordkeeping System
Entries in the Register of Grants for Special Purposes are in consecutive number order which is roughly chronological. Where there is an alphabetical index, the parish and the entry number are given.
Entries in the Register of Pre-Emptive Right Descriptions are in chronological order. Alphabetical indexes to parishes, grantees names and the names of homesteads or runs are available.
