Function / Content
Writs of Habeas Corpus are directed at a person who detains another in custody and demands that the custodian produce that person before the Court for Specified purpose. A number of the Writs in this series are to the persons in charge of prisons requiring the production of a prisoner for examination as a witness in cases before the Court whilst others were sought when children had been removed by one parent from the custody of the other parent.
This series consists of the files relating to applications for Writs of Habeas Corpus to the Supreme Court. Files may include a petition for Habeas Corpus, affidavits in support of the application and the Writ of Habeas Corpus.
Recordkeeping System
Until 1856, files are arranged in chronological bundles with a cover board giving the numbers allocated cases within that bundle and the name of the person for whom the writ was applied for. From 1857, files are in consecutive number order. In 1985 the system of arrangement changed to an annual single number system.
